Terms of Service

1. General Provisions
These Terms of Service (hereinafter — "Terms") govern the relationship between [legal entity name] (EDRPOU/RNOKPP: [code], hereinafter — "Zbery", "we") and the user (hereinafter — "you", "User") when using the Zbery service available at zbery.app (hereinafter — "Service").
By registering or using the Service, you confirm that:
- you have read and agree to these Terms
- you are at least 13 years old
- you have the legal right to enter into agreements, or have obtained parental/guardian consent
If you do not agree to these Terms — do not use the Service.
2. Service Description
Zbery is an AI-powered shopping list management service. The Service allows you to:
- create and manage shopping lists
- use AI for automatic structuring and categorization of lists
- share lists with other users (within your plan's limits)
The Service collects and processes personal data in accordance with the Privacy Policy, which forms an integral part of these Terms.
3. Registration and Account
3.1 To access the Service, you must sign in with a Google account (Google OAuth). We do not support password-based registration.
3.2 You are responsible for:
- maintaining the confidentiality of your Google account
- all actions taken through your Zbery account
3.3 In the event of unauthorized access to your account — notify us immediately at [support@zbery.app].
3.4 We reserve the right to suspend or delete an account in case of a violation of these Terms.
4. Plans
Free Plan
The Free plan is provided without a time limit and includes:
- 1 active shopping list
- up to 50 items per list
- up to 50 AI queries per month
- basic list management features
Premium Plan
The Premium plan is provided on a paid basis and includes expanded features as described on the pricing page.
Current prices:
- UAH 99 / month
- UAH 790 / year (save 2 months)
Prices include VAT (where applicable). We reserve the right to change prices with 30 days' prior notice.
5. Payment and Subscription
5.1 Payments are processed through the LiqPay payment service. We do not store your bank card data.
5.2 Auto-renewal. The subscription renews automatically at the end of each paid period. You may cancel auto-renewal at any time in account settings — the subscription will remain active until the end of the paid period.
5.3 Trial period. If a free trial period is offered, after it ends the subscription automatically converts to a paid plan unless you cancel before the trial expires.
5.4 Refunds. We provide a full refund within 7 days of the first payment for any plan if you are not satisfied with the Service. To request a refund — contact us at [support@zbery.app]. Refunds for subsequent payments are made only in exceptional cases — for example, extended Service unavailability due to our fault (more than 72 consecutive hours).
5.5 Plan changes. When downgrading from an annual to a monthly plan — the change takes effect at the next billing cycle. When upgrading from monthly to annual — billing occurs immediately, and the remaining current month is prorated.
6. Acceptable Use
You may:
- use the Service for personal and family needs
- share list access with family members within your plan's limits
- store backups of your own data
You may not:
- use the Service for commercial resale or transfer access to third parties
- make automated requests (scraping, bots) without written consent
- attempt to bypass technical restrictions or gain unauthorized access
- upload or distribute illegal content
- use the Service in a way that violates the rights of others or Ukrainian law
7. Intellectual Property
7.1 The Service, including its code, design, logo, content, and AI models, is the exclusive property of Zbery and is protected by copyright and other intellectual property laws.
7.2 Content you create in the Service (list names, products, etc.) belongs to you. You grant us a limited license to store and process this content solely for the purpose of providing the Service.
7.3 We make no claim to ownership of your shopping lists or AI text queries.
8. Limitation of Liability
8.1 The Service is provided "as is". We do not guarantee uninterrupted Service operation and are not liable for technical failures related to third-party services (hosting, Google OAuth, AI services).
8.2 We are not liable for:
- data loss caused by user actions or circumstances beyond our control
- purchase decisions made based on AI recommendations
- any indirect or consequential damages
8.3 In any case, our liability shall not exceed the amount paid by you for the Service during the 3 months preceding the event that caused the damage.
8.4 AI features of the Service provide automated recommendations. We do not guarantee the accuracy, completeness, or suitability of AI results for your specific needs. Please verify lists before shopping.
9. Service Availability
We strive to ensure 24/7 availability of the Service, but do not guarantee it. Planned maintenance is carried out during off-peak hours with prior notice when possible. In case of extended unavailability (more than 72 consecutive hours) due to our fault — you are entitled to a proportional partial refund.
10. Changes and Termination
10.1 We reserve the right to modify these Terms. We will provide notice of significant changes at least 14 days in advance via email or in-Service notification. Continued use after changes take effect constitutes acceptance.
10.2 You may delete your account at any time in settings. After deletion, all your data will be removed within 30 days, and any subscription will be cancelled without a refund for the unused period (except as provided in clause 5.4).
10.3 We reserve the right to suspend or delete an account for violations of these Terms, with prior warning (except for serious violations — spam, illegal content, hacking attempts).
11. Dispute Resolution
11.1 These Terms are governed by the laws of Ukraine.
11.2 In case of disputes, the parties will attempt to resolve them through negotiation. Please contact us at [support@zbery.app] — we will respond within 10 business days.
11.3 If the dispute cannot be resolved amicably, it shall be submitted to the competent court at the Operator's registered location in accordance with Ukrainian law.
